Terms of sale

The agreement is drawn up and carried out in Bologna, regardless from where the commission/order is sent. When ordering, specify the area code, the number of the Vespa chassis/model and the reference code of this catalogue. The goods will travel at customer/consignee's risk. Shipping insurance may be requested by specifying such in the order notes.
We are not responsible for possible accidents or damages caused by the use-employment of our products.
Any dispute shall be subject to the jurisdiction of the Court of Bologna.

Orders

Orders are received only and exclusively on-line. After placing an order on-line, the customer will receive an order confirmation via email with the corresponding order number and any possible notes regarding products which are out of stock.

Warranty

In accordance with Art. 128 et seq., Legislative Decree No. 206, of 6 September 2005, a 2-year warranty is applicable only to purchases by private consumers. Purchases madeby VAT-registered professionals are covered by the rules set forth in the Civil Code, with a warranty lasting 12 months. In order for the warranty to be valid, the product must be used correctly, respecting its intended use and according to that described in the included documentation; a claim is valid only if accompanied by the original shipping documents. Parts subject to wear are excluded from the warranty.

The warranty is void if:

the products have been installed or assembled by unqualified individuals;
the products have not been used according to the manufacturer's specifications;
the products have been tampered with;
the products are not intact;
the products do not bear the warranty label with the serial number;
the products do not include the original packaging, accessories, and manuals;
the products have been subjected to electric shocks and voltages not conforming to the characteristics of the product, as described in the manual or information labels;
the products have undergone modifications which are unauthorized and/or do not conform to the Manufacturer's specifications;
the faults or defects have been caused by foreign material and/or conflicts with add-on components - the products have undergone repairs performed by customers without prior authorisation.
For assistance during the warranty period, please send an email to info@vespatime.it indicating the nature and characteristics of the defect discovered, enclosing all purchase documents (transport document, etc.). The products must be received exclusively in original packaging. Any receipt of merchandise which has not been previously authorised will be absolutely rejected.

Right of rescission

In accordance with Legislative Decree No. 206 of 6 September 2005, the consumer has the right to rescind any distance contract, without penalty and without specifying the reason, within but not beyond a period of 14 working days from receipt of goods. This right is exercisable only by those who purchase as individuals for personal purposes not related to their work activity. The right of rescission is exercised, under the provisions of Art. 73, paragraph 5 of Legislative Decree No 206 of 6 September 2005, by sending within the specified timeframe a recorded delivery letter with advice of delivery, addressed to Ascanio Tugnoli Srl, Via STELLONI 17B 40010 SALA BOLOGNESE (BO), Italy. After receiving such notice, we will contact the customer to indicate how to return the goods. In accordance with Art. 67, paragraph 3, the product is returned to the sender at the consumer's expense. No refund shall be issued if the merchandise is not intact, in its original packing or container, with adequate external packaging; likewise, there shall be no refund if merchandise has been used or altered, is missing the original accessories and documentation, and is not provided with the original transport documents. Returns not previously arranged will not be accepted. Shipping is under the full responsibility of the customer until proof of receipt in our warehouse. In the event the goods are damaged during transport, Ascanio Tugnoli Srl will notify the customer, to allow the customer to file a timely complaint against the chosen carrier and be reimbursed the value of the good (if insured); in such case, the product will be madeavailable to the customer for its return, simultaneously cancelling the request for rescission. Ascanio Tugnoli Srl is not responsible in any way for damages or theft/loss of goods returned by uninsured shipments. Upon arrival at the warehouse, the product will be examined to assess any damages not caused by transport. If the original envelope and/or packaging are damaged, Ascanio Tugnoli Srl will retain a percentage of the refund due, not to exceed 10%, to offset restoration costs.

Processing of personal data

Leg. Dec. No. 196/2003 provides that the processing of personal data shall respect the rights of fundamental freedom and dignity of individuals, with particular reference to privacy and personal identity. We will treat your data fairly and in accordance with the law, with full protection of your rights, and in particular your privacy. In accordance with Leg. Dec. No. 196/2003, Ascanio Tugnoli Srl advises you that your personal data will be processed with the sole purpose of completing the contract. Your information will necessarily be transmitted to the shipping company with which we operate. Consent to the processing of such information is required in order to complete the contract of sale. Such consent entitles Ascanio Tugnoli Srl to inform you about future news, discounts and promotional initiatives. Acceptance of this form of processing is optional. Information in our possession will not be used under any circumstances for any purpose other than those previously indicated.
